“Is This a Refund or a Silent Operation?” CWIG Strikes Back at Bat Bank’s Procedures

Jakarta, otoritas.co.id — At a time when the public is celebrating Eid with a spirit of openness and honesty, Cerdas Waspada Investasi Global (CWIG) has instead revealed what it calls a “serious anomaly”: a refund scheme deemed non-transparent and heavily tilted toward one-sided interests.

CWIG Chairman, Henry Hosang, stated that the mechanism implemented by Bat Bank is not merely a standard procedure, but a pattern that raises suspicion of unilateral risk control at the expense of customers.

“This is not just a procedure. This is a pattern. And the pattern points to one thing: how funds remain controlled while risks are shifted,” Henry asserted.

CWIG highlighted the requirement for customers to sign forms prepared unilaterally as a gateway to receiving refunds. The document contains clauses considered unusual in sound financial practices.

These include the obligation to return the original Demand Deposit Certificate (DDC), a declaration waiving the right to pursue legal action in the future, and a staged payment scheme (in installments) that does not provide full certainty to customers.

“Let’s read this clearly: the DDC is taken back, legal rights are waived (the victim no longer holds the original DDC as evidence), and the funds are returned in stages. Is this a refund, or a forced unilateral negotiation?” he said.

Henry further emphasized the sharp contradiction between claims of readiness to refund and the conditions that actually weaken the customer’s position.

“If they are truly ready to return the funds, why require a waiver of rights? Why impose delays? Why not return the full amount? And most importantly: what was the legal basis from the beginning for collecting these funds?” he questioned.

CWIG considers this issue of legality as “the elephant in the room” that Bat Bank continues to avoid.

“This is not about willingness to pay or not. This is about the very beginning: who authorized PT BAT Instrumen Bank Internasional (Bat Bank) to operate and collect public funds while using the name ‘Bank’?

This question should be openly addressed by Bat Bank’s management, including its CEO and legal advisors. If this cannot be clearly explained, then all subsequent activities—including Bat Bank’s procedures—must be questioned,” he stressed.

Based on information received by CWIG from an internal source (whistleblower), there are indications of a recurring pattern where customers who have followed the procedures still do not receive full refunds. A portion of the funds is paid, while the remainder lacks certainty of settlement.

“This is the danger. When part is paid, the rest can be pushed into a civil dispute. What does that mean? Potential criminal liability may disappear, and customers are left to fight on their own. This is an old pattern with a new packaging,” Henry explained.

He even described the situation as a practice that “appears legal on paper, but potentially causes systematic harm in reality.”

CWIG also warned customers, particularly those in the platinum membership scheme, not to fall into what it calls a “procedural trap.”

“Don’t let the attempt to reclaim your rights lead you into unknowingly signing them away,” he said.

Furthermore, CWIG highlighted a statement made during a 15-minute 57-second presentation at Bat Bank’s office by an individual identified as the CEO of Bat Bank, Achmad Nur Sulaiman, who is also listed in official company documents under the name Dato Sulaiman.

On the other hand, based on investigative findings and document analysis, there are indications of the use of other identities associated with the same individual, including Ibrahim Bin Salleh and Abdul Rahim Salim, each reportedly linked to different jurisdictions.

CWIG considers this finding serious and potentially strengthening public concerns, and stated that it will be submitted as part of the ongoing legal process at Polda Metro Jaya.

“Bat Bank, as a party claiming to provide facilities such as SBLC, LC, OD, or bank guarantees, should only earn fees or commissions. Therefore, a fundamental question arises: why were the funds not placed in official banks, but instead centralized within Bat Bank?” Henry stated.

CWIG also raised serious concerns regarding the Demand Deposit Certificate (DDC) used in the scheme.

“This document is not just a piece of paper. It concerns legitimacy. It bears the state emblem (Garuda), which Bat Bank allegedly claims as ‘printing money of Indonesia,’ issued by Peruri and registered with Bank Indonesia. If there is anything unlawful in its creation, this could escalate into a far more serious matter,” he stressed.

CWIG stated that it has identified parties allegedly involved in the creation of these documents and will bring the matter to law enforcement authorities.

“This is no longer a discourse. This is about accountability,” Henry continued.

“CWIG submits all these findings to law enforcement authorities to be tested objectively.”

“If you believe you are right, come to Polda Metro Jaya. Explain. Prove it. Don’t hide behind the term ‘procedure’,” he said firmly.

“This is a state governed by law, not a space for unilateral negotiation. Everyone is subject to the same rules. No one is above the law. Do not test the public’s patience,” Henry concluded.
